Declaration of Heirs: A key step in the inheritance process
When a person passes away without leaving a will, it is essential to carry out a Declaration of Heirs before a Notary. This legal process officially recognizes who the rightful heirs are and is required in order to move forward with the distribution of any assets, such as real estate, vehicles, or bank accounts.
Without this declaration, it is not possible to transfer ownership or access the deceased’s assets. Banks, the Land Registry, and other institutions will request this document before allowing any changes or transactions.
In some cases, however, a formal adjudication of the inheritance (the division and allocation of assets) may not be necessary. For example, if the estate has no valuable assets to be distributed, or if the heirs decide not to divide the assets at that moment, they may postpone or avoid the adjudication process. Still, the declaration itself remains a crucial step when there are assets involved and no will has been made.
